DoorDash spokesperson on Prop 22: ‘this law, enacted by the people, should be here to stay’

A spokesperson for DoorDash told Flexible Work News on June 12 that California voters and gig workers support Proposition (Prop) 22, a voter-approved measure classifying gig workers as independent contractors rather than employees.

"California voters and Dashers made it overwhelmingly clear that they support Prop 22 when they passed the law with nearly 60 percent of the vote," said the spokesperson. "The Supreme Court hearing was a reminder that this law, enacted by the people, should be here to stay. More than 80 percent of Dashers and other app-based workers say that Prop 22 should remain the law, and it is our hope that the Court will agree."

Voters approved Prop 22 in 2020 with 58.63% of the vote, according to Ballotpedia. In 2021, a Superior Court Judge deemed the measure unconstitutional, but an appellate court overturned that ruling the following year. The California Supreme Court is now reviewing the case.

According to a post on DoorDash’s website, DoorDash delivery workers, or "Dashers," have seen an increase in earnings in California since the enactment of Prop 22. In 2023, California-based Dashers earned approximately $36 per hour while completing deliveries, representing a 41% increase compared to 2020. Benefits provided to Dashers through Prop 22 include a healthcare stipend for those who work at least 15 hours per week. Dashers also report that they value the flexibility and independence affiliated with gig work. There are more than 200,000 Dashers in California.

Prop 22 established a minimum earnings guarantee for California-based gig workers, according to a guide for workers on DoorDash’s website. Dashers are guaranteed to earn at least 120% of the minimum wage for the time spent between accepting and completing a delivery, plus 35 cents per mile for Dashers who use a car, e-scooter, or other motor vehicle. Any tips a Dasher receives do not count toward the minimum earning guarantee.

DoorDash operates across the U.S., partnering with restaurants to provide on-demand food delivery service, according to Business Insider. DoorDash also offers data analytics to restaurants that use its platform to enable them to track sales and metrics such as their most popular menu items.
